Terms and conditions

“Customer” means the Customer whose name is set out in the Quotation and who will pay for the Works.
“Premises” means the Customer address set out in the Quotation at which the Works are to be completed.
“Works” means the works which Energy Assist Group has been called by the Customer to the Premises to perform.
1. The Customer acknowledges that Energy Assist may engage an agent or sub contractor to perform the Works.
2. The Customer of the Premises must be present while the Works are started and completed.
3. The Customer must provide clear and safe access to all relevant areas within the Premises to which access is required in order to carry out the Works.
4. Any times quoted for delivery are estimates only, involving no contractual obligation and Energy Assist shall not be liable to the Customer to make good any damage or loss whether arising directly or indirectly out of the delay in installation and commissioning. Time will not be of the essence for any installation and commissioning.
5. If a clear and present danger is discovered, and the rectification of this hazard is not part of the Works, this further Work must be authorised separately by the Customer. In the event of an electrical hazard, the relevant portion or the whole of the wiring system in the Premises may be disconnected from the electricity supply to render the situation safe and will not be reconnected until the hazard has been removed.
6. To the extent permitted by law, Energy Assist Group and its agents and contractors are not liable for any consequential loss or damage nor for any loss of profits, business, income or anticipated savings however caused, including without limitation, through breach of contract, in tort (excluding negligence), inequity, or for breach of statute in relation to the Works.
7. Warranties:
*  Electrical work In accordance with Certificate of Electrical Safety
* Workmanship 10 years from date of installation
* Relevant manufacturer’s warranty applies to solar panels, inverters and all other parts, from the date the relevant works are completed.
8. Due to the nature the Works, it may be necessary to cut openings for access in walls, floors ceilings or disturb finished surfaces during the installation of wiring, panels, rails, inverter, etc. Energy Assist Group will endeavour to inform you if this is necessary. Also, older homes with lath and plaster walls or ceilings may experience cracks appearing due to its fragility. The making good of any surfaces such as patching or painting is the responsibility of the person authorising the works, unless agreed in writing by Energy Assist Group.
9. Goods supplied to the Customer by Energy Assist shall remain the sole and absolute property of Energy Assist until installation of the Goods has been completed by Energy Assist or its servants, contractors or agents and payment has been received in full or REC/STC’s (of a value to constitute payment in full for the Goods) are assigned to Energy Assist.
10. Payment of the deposit is required upon acceptance of the quote, with the balance payment due on the day the installation of the system is completed, not when the meter is installed. The balance must be paid and/or evidence of the payment must be provided to the technician on site once the installation is complete. The Customer must pay to Energy Assist Group the full charges for the Works set out in the quote and invoice in full without deduction. All payments are to be made by Cash or bank cheque as set out in the quotation. Should payment fall outside the terms set out in the quotation interest is payable by the Customer thereafter on demand at the rate of twelve percent (12%) per annum calculated daily until the date of payment of the outstanding balance.
11. All costs (including but not limited to legal costs) incurred by Energy Assist in obtaining payment from the Customer or in endeavouring to trace the whereabouts of the Goods or obtaining or endeavouring to obtain possession thereof, whether by action or suit or otherwise, and all other transport, storage, sale, repossession and like expenses shall all be recoverable by Energy Assist from the Customer in addition to and without prejudice to Energy Assist’s other rights under these Terms and Conditions of Sale.
12. Any quotes for Works to be performed is current for a period of 7 days from the date of the quote. All prices and charges are inclusive of GST unless otherwise stated. If the Works authorised to commence through the payment of the deposit is not received within 7 days of the date of the quote, Energy Assist Group may review and amend the quote and advise the Customer accordingly.
13. These terms and conditions are governed by the laws of the State of Victoria and each of the parties irrevocably submits to the jurisdiction of the courts of that State.
14. No alterations or amendments to the form of these terms and conditions are effective unless the prior written approval of Energy Assist Group is obtained.

Privacy Statement: Energy Assist Group collects information about the Customer, such as contact details, for the purpose of providing energy-related goods and services. Energy Assist Group may provide this information to Energy Assist Group contractors to assist in service delivery, on the condition that it is kept secure and used only for the appropriate purpose.
